These Terms constitute a legally binding agreement between you and Club-Healthy.com. If you do not agree to these terms, please immediately discontinue your use of our services.
Club-Healthy.com acts as an intermediary platform designed to connect premium nutritional brands with health-conscious consumers. We facilitate promotional product distributions, sample programs, rebates, and special offers (collectively, "Promotions"). We do not sell products directly to consumers, nor do we act as a retailer.
We are not a review service. Club-Healthy.com does not solicit, request, purchase, broker, exchange, incentivize, or otherwise arrange for customer reviews, ratings, seller feedback, or testimonials on Amazon or on any other marketplace, retailer, or platform. No Promotion offered by Club-Healthy.com is, or has ever been, conditioned on a user writing, altering, or removing a review. Any communication you receive that suggests otherwise did not originate from an authorized representative of Club-Healthy.com acting within the scope of their authority, and should be reported to us immediately (see Section 6).
To ensure fairness and prevent fraudulent activity, all Promotions, gifts, and product distributions facilitated through Club-Healthy.com are subject to strict limitations:
Per-Person and Per-Purchase Limit: Unless explicitly stated otherwise in writing, all gifts, promotional items, or rewards are strictly limited to one (1) gift per person, per unique purchase of an eligible ASIN/product.
Strict Verification: We reserve the right to verify your purchase, including requesting proof of order, Amazon Standard Identification Numbers (ASINs), transaction receipts, and identity verification.
No Review Requirement — Ever: Eligibility for any gift, rebate, sample, or promotional item is never contingent upon leaving a review, providing a star rating, submitting seller feedback, posting a photo or video testimonial, or modifying or deleting an existing review. You are under no obligation of any kind to post a review in order to receive, or to keep, anything distributed through this platform. Verification requests exist solely to confirm a legitimate purchase occurred — never to confirm that a review was posted.
Abuse and Duplication: Any attempt to claim multiple gifts for a single purchase, utilizing multiple email addresses, creating duplicate accounts, or using fraudulent order numbers will result in the immediate forfeiture of the promotional item and the permanent termination of your access to Club-Healthy.com.
Availability: All gifts and promotional items are available in limited quantities, on a first-come, first-served basis, and while supplies last. Club-Healthy.com reserves the right to substitute, modify, or cancel any promotion at any time without prior notice.
No Affiliation: Club-Healthy.com operates strictly as an independent third-party marketing partner and promotional facilitator. We are not affiliated with, owned by, or legally partnered with the manufacturing, fulfillment, or daily business operations of our featured partner brands.
Product Inquiries and Support: Because we do not manufacture, store, or ship the physical products, Club-Healthy.com cannot handle product customer service. For any questions, safety concerns, defects, shipping delays, or specific inquiries regarding a partner brand's products, you must contact the respective brand or manufacturer directly.
Product Liability Disclaimer: Club-Healthy.com assumes no responsibility, liability, or obligation for the products distributed by third-party brands, including but not limited to product efficacy, adverse health reactions, or labeling inaccuracies.
By using this website, you represent that you are at least 18 years of age and possess the legal authority to enter into this agreement. You agree to use the site exclusively for lawful purposes and agree not to:
Submit false, inaccurate, or misleading information during registration or the promotional claim process.
Manipulate, reverse-engineer, or attempt to bypass the security mechanisms of the platform.
Engage in any automated data collection, scraping, or extraction methods.
Solicit, demand, offer, accept, or negotiate money, gift cards, free or discounted product, refunds, cryptocurrency, or any other item of value in exchange for a review, rating, or seller feedback — whether directed at Club-Healthy.com, its staff, its contractors, its partner brands, or any other user. This prohibition applies in both directions: you may neither pay for reviews nor sell your own.
Represent yourself as an employee, agent, affiliate, contractor, or authorized representative of Club-Healthy.com, or use our name, logo, or brand identity to solicit reviews or payment from any third party.
Condition, threaten, or leverage the posting, alteration, or removal of a review in order to extract compensation, replacement product, or preferential treatment from Club-Healthy.com or a partner brand.
This Section applies to all users, employees, contractors, agents, affiliates, brand partners, marketing associates, and any other person acting on behalf of or in connection with Club-Healthy.com (collectively, "Associates").
No Associate of Club-Healthy.com is permitted, under any circumstance, to ask a consumer for money, payment, or anything of value in exchange for a review — nor to offer a consumer money, payment, or anything of value in exchange for writing, altering, or removing a review. Compensated, incentivized, or otherwise manipulated reviews are unlawful and are prohibited without exception.
Paying for, soliciting payment for, brokering, or facilitating fake or incentivized consumer reviews is illegal in the United States and in numerous other jurisdictions. Such conduct violates, among other authorities, Section 5 of the Federal Trade Commission Act (15 U.S.C. § 45), the FTC's Rule on the Use of Consumer Reviews and Testimonials (16 C.F.R. Part 465), and applicable state consumer-protection and unfair-trade-practices statutes. It additionally violates the published policies of major marketplaces, including the Amazon Community Guidelines and Amazon Seller Code of Conduct. Violations may expose the offending party to civil monetary penalties, marketplace account suspension, and referral to law enforcement or regulatory authorities.
Any person — whether a user, an Associate, an employee, a contractor, or a third party — who requests, solicits, demands, offers, or accepts money or any other item of value from or on behalf of any Associate of Club-Healthy.com in exchange for a review is subject to immediate and permanent lifetime termination of their Club-Healthy.com account and any and all associated accounts, and to permanent disqualification from every current and future Promotion, program, or service operated by Club-Healthy.com. This termination is lifetime in duration, is not appealable, and applies across all email addresses, payment identifiers, shipping addresses, and devices reasonably associated with the offending party. Associates found in violation are additionally subject to immediate termination of their employment or engagement.
If any person contacts you claiming to represent Club-Healthy.com and offers you money, free product, a refund, a gift card, or any other benefit in exchange for a review — or asks you to pay for a review — do not engage, and report it to us immediately at info@club-healthy.com with any screenshots, message headers, sender addresses, and order details available to you.
Club-Healthy.com will investigate all such reports, will not retaliate against any user who submits a good-faith report, and reserves the right to refer confirmed incidents to the relevant marketplace, partner brand, regulatory body, and/or law enforcement agency, and to cooperate fully with any resulting investigation.
No Associate has actual or apparent authority to solicit paid reviews, to promise compensation for reviews, or to condition any Promotion on a review. Any such solicitation is made outside the scope of that Associate's authority, is void, is unenforceable against Club-Healthy.com, and creates no obligation of any kind on the part of Club-Healthy.com.
Nothing in this Section discourages you from voluntarily sharing your honest, independent opinion of a product wherever you choose. You are simply never required to do so, never compensated for doing so, and never penalized for declining, for deleting a review, or for leaving a negative one. Your eligibility for Promotions is entirely unaffected by the content, sentiment, rating, or existence of any review you may or may not write.
6. Right to Refuse Service and Termination
Club-Healthy.com reserves the right to refuse service, terminate accounts, deny promotional claims, or restrict access to our website and platform to any individual at any time, for any reason, at our sole and absolute discretion, without prior notice or liability.
Reasons for the rejection of services, cancellation of promotional benefits, or platform bans may include, but are not limited to, the following:
Fraudulent Activity: Any suspected, attempted, or actual fraud, including the submission of falsified Amazon order numbers, recycled receipts, duplicate email addresses, or manipulation of the promotional validation process.
Review Manipulation (Lifetime Ban): Soliciting, demanding, offering, accepting, brokering, or facilitating money or any other item of value in exchange for a review, rating, or seller feedback, as described in Section 5. This conduct is illegal and carries a permanent, lifetime, non-appealable ban from Club-Healthy.com and all of its Promotions.
Impersonation: Falsely holding oneself out as an employee, agent, or authorized representative of Club-Healthy.com, including for the purpose of soliciting reviews or payment.
Abusive Conduct: The use of rude, profane, threatening, harassing, discriminatory, or otherwise inappropriate language and behavior directed toward Club-Healthy.com staff, support representatives, or our partner brands.
Extortion or Review Leverage: Threatening to post, alter, or withhold removal of a negative review in order to obtain money, product, refunds, or preferential treatment.
System Manipulation: Any attempt to exploit technical glitches, bypass automated security checks, use bots or scripts, or engage in malicious behavior that disrupts the intended operation of our website.
Discretionary Rejection: We reserve the right to deny service or cancel a promotional distribution based on our internal risk assessments, inventory shortages, changes in partner brand agreements, or simply because we deem an individual's engagement incompatible with our platform's community standards and business objectives.
All determinations regarding violations of these Terms or the eligibility of a user to receive promotional gifts are final and binding. In the event that your access is terminated or a promotional claim is rejected by Club-Healthy.com, you acknowledge that we are under no obligation to provide a replacement gift, cash equivalent, or alternative compensation.
All content, logos, text, graphics, user interfaces, trademarks, and digital assets found on Club-Healthy.com are the exclusive property of Club-Healthy.com or its partner brands. This material is protected by applicable copyright, trademark, and intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to access the site for personal, non-commercial use only.
Club-Healthy.com provides its platform, website, and promotional services on an "as-is" and "as-available" basis. To the maximum extent permitted by applicable law, we make no representations or warranties of any kind, express or implied, regarding the operation of the site, the accuracy of its content, or the products offered by partner brands. We do not warrant that the website will be uninterrupted, error-free, or free of viruses.
To the fullest extent permitted by law, Club-Healthy.com, its directors, employees, and affiliates shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages resulting from:
Your use of, or inability to use, our website or promotional platform.
The consumption, ingestion, or use of any products manufactured and provided by our third-party partner brands.
Any unauthorized access to or alteration of your transmissions or data.
Any unauthorized act of any person purporting to represent Club-Healthy.com, including any unauthorized solicitation of, or offer of payment for, consumer reviews, which is expressly prohibited under Section 5 and falls outside the scope of any Associate's authority.
You agree to defend, indemnify, and hold harmless Club-Healthy.com, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or in any way connected to your violation of these Terms or your misuse of the platform and its promotions, including without limitation any claim arising from your participation in, or facilitation of, the purchase or sale of consumer reviews.
We reserve the right, at our sole discretion, to modify, update, or replace these Terms of Service at any time. The date of the most recent update will always be posted at the top of this page. Your continued use of the website following the posting of any changes constitutes acceptance of those modifications.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Club-Healthy.com operates, without regard to its conflict of law principles. Any dispute arising under or relating to these Terms shall be resolved exclusively through binding arbitration or within the local courts of our designated jurisdiction.
If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a court or tribunal of competent jurisdiction, that provision shall be severed and the remaining provisions shall continue in full force and effect.
